Disputes
Kentucky law governs these terms, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration of the SMS program as described in the SMS Terms & Conditions. Courts located in Kentucky are the venue for disputes that are not subject to that arbitration agreement. If we prevail in a suit to enforce these terms, we may recover reasonable attorneys’ fees and costs to the extent the law allows.
